TERMS & CONDITION

These Terms & Conditions (“Terms”) govern your use of wayangworks.com (the “Site”) and any production, post-production, or related services provided by WW Gold Sdn Bhd (“Wayang Works,” “we,” “us”). By using our Site or engaging our services, you agree to these Terms.

1. Services & Engagement

1.1 Scope, deliverables, timeline, and fees are defined in a written Quotation/Statement of Work (SOW).
1.2 A booking is confirmed upon written acceptance of the Quotation/SOW and payment of any required deposit.

2. Fees, Deposits & Payment

2.1 Prices are quoted in MYR unless otherwise stated. International payments may be accepted in USD by prior arrangement.
2.2 Unless stated otherwise: 50% deposit to confirm, 50% balance on delivery/approval or per the SOW milestones.
2.3 All bank/card fees, currency conversion charges, and taxes (e.g., SST, withholding tax) are payable by the client unless agreed otherwise.

3. Changes & Overtime

3.1 Client-requested changes beyond the agreed scope, additional shoot days, or extra revisions are chargeable at our prevailing rates.
3.2 Overtime, rush fees, and extraordinary expenses (permits, locations, travel) are billable with prior client approval where possible.

4. Cancellations & Postponements

4.1 If the client cancels after confirmation, deposits are non-refundable.
4.2 Cancellation/postponement fees may apply to cover crew, location, equipment, and third-party costs already committed (see Refund Policy).

5. Intellectual Property

5.1 Unless the SOW states otherwise, all underlying production assets and project files remain Wayang Works’ property until full and final payment.
5.2 Final deliverables are licensed or assigned to the client as specified in the SOW (territory, term, media).
5.3 Use of our name, logo, or behind-the-scenes materials requires written consent.

6. Client Responsibilities

6.1 The client warrants it has the necessary rights to all materials provided and will obtain any required releases/permissions.
6.2 The client will provide timely approvals and a single point of contact to avoid delays.

7. Limitation of Liability

7.1 To the maximum extent permitted by law, our total liability is limited to the amount paid by the client for the specific SOW giving rise to the claim.
7.2 We are not liable for indirect or consequential losses, including lost profits or opportunity.

8. Force Majeure

We are not responsible for delays or non-performance due to events beyond our reasonable control (e.g., acts of God, government restrictions, strikes, epidemics).

9. Privacy

Use of the Site and our services is also governed by our Privacy Policy.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of Malaysia. Disputes shall first be attempted via good-faith negotiation; failing which, parties may proceed in the courts of Malaysia.

REFUND AND CANCELLATION

We aim to be fair and transparent. This policy applies to services booked with WW Gold Sdn Bhd.

1. Deposits

  • Deposits are non-refundable once a booking is confirmed, as we secure crew, equipment, and locations.

2. Cancellations by Client

  • 7+ days before first shoot/service date: client pays actual committed costs (e.g., confirmed crew, locations, equipment, travel) plus 10% admin fee; any remaining prepayment is credited or refunded.

  • Within 7 days of first date: up to 100% of the quoted day-rates and committed costs may be chargeable, depending on the stage of prep.

  • Same-day/no-show: considered a full-charge day.

3. Postponements

  • We’ll try to move dates at no extra charge if vendors can accommodate. Any third-party change fees or rate increases are billable.

4. Changes in Scope

  • Additional shoot days, locations, hours, or extra revisions are billed at our prevailing rates, agreed in writing.

5. Refund Method

  • Approved refunds (if any) are processed to the original payment method within 10–14 business days. Card/bank processing times may vary.

6. Force Majeure

  • Events beyond reasonable control (e.g., severe weather, government restrictions) may require date changes or partial cancellation. We will act in good faith to minimise costs.

Terms of Sale (Payments)

Accepted methods: Bank transfer, credit/debit card (via Payment Page or Payment Link), and other methods as enabled on our dashboard.
Currencies: MYR (default). USD may be accepted for international projects by prior arrangement.
Invoices & Receipts: Issued via email with SSM details and tax info where applicable.
Late payments: We may charge late fees and suspend work/delivery until cleared funds are received.
Security: Card data is processed by PCI-compliant providers; Wayang Works does not store full card details.
